A tractor trailer driver is being charged after he left the scene of a fatal accident on I-77 in Jackson County, West Virginia on March 30.
West Virginia State Police reported that the truck driver has been charged with leaving the scene of an accident and also giving false information to the police.
The fatal truck accident happened on the evening on March 30 at the Kenna exit on I-77 in West Virginia.
The tractor trailer slammed into a pick up truck, killing a 33 year old man. Troopers say the big rig dragged the truck for a mile before it became detached.
The state police reported that the pickup truck was virtually destroyed and the driver was probably killed instantly.
The police also stated that the big rig driver continued to drive for another 1.5 miles, and he was seen trying to get rid of evidence that was on his rig. He also did not show indications that he was going to call the police or return to the scene.
It is likely that the tractor trailer driver will face additional charges.
Our Virginia and North Carolina truck accident attorneys are alarmed that this truck driver failed to uphold his commercial truck driving duties. It is the job of all commercial truck drivers to put the public safety first on the roads. If there is an accident, the truck driver is legally obligated to call the police and to stay at the scene of the accident.
There is nothing of course that we can do to bring back those who are no longer with us, but it is possible for justice to be served in this truck accident case. The first legal matter will be the criminal case against the tractor trailer driver. It is possible that he will face serious criminal penalties if convicted of a crime, including jail time and fines.
But many grieving families do not know that they also can seek justice through a wrongful death lawsuit. While the truck driver may have to do jail time if he is convicted, this fact will not help the family of the lost. If the deceased driver had a family and children, how will they be cared for? A successful wrongful death lawsuit can provide much needed financial help to a devastated family.
