Recently, a gastric bypass medical error/wrongful death case was settled for over $800,000.00 on the morning of jury trial in Norfolk, Virginia (VA).
The case in the Norfolk Circuit Court involved a 28 year old single mother who had an 8 year old handicapped child. After trying to diet and exercise to lose weight, she agreed to undergo a laparoscopic gastric bypass surgery. After the surgery, she developed symptoms of obstruction, which were improperly treated by the health care providers. The surgeons failed to recognize the significance of lab findings and an upper gastrointestinal series, which showed significant partial obstruction requiring intervention. All the doctors did was to treat the patient with anti-nauseous medication. Two and a half weeks after the surgery the obstruction ruptured. Ultimately, after multiple surgeries, the woman died.
