The Food and Drug Administration (FDA) recently inspected the Danville, Virginia (VA) factory which produced the Nestle Toll House cookie dough which contained E. coli, according to the Daily Press. The reports show a complete lack of compliance on the part of Nestle USA. Between 2004 and 2007, Nestle failed to provide important documents such as complaint logs and pest-control records to the FDA.
So far, 69 people in 29 states – including Virginia (VA) – have been sickened due to the E. coli outbreak from the cookie dough. Clearly, Nestle is at fault for these illnesses due to their procrastination and sheer insolence toward FDA requests.
As an injury lawyer with 20 years of experience representing clients who’ve suffered severe injuries due to big companies failing to follow basic safety measures, it’s frustrating to hear about another company needlessly allowing people to get sick.

This isn’t the first time Virginia (VA) has been embroiled in a food poisoning controversy. There was a recent outbreak of salmonella connected to peanut butter manufactured by Peanut Corp. in Lynchburg, Virginia (VA), according to Fox News. Two Virginians died as a result of this outbreak and over 500 people were sickened.
Food poisoning affects roughly 25 percent of Americans every year and if you have a case of diarrhea which lasts more than a day, there’s a 1-in-3 chance you had food poisoning, according to chinadaily.com.
When E. coli enters your body it causes abdominal cramping, vomiting, nausea, and the aforementioned diarrhea. Serious complications can occur, especially in young children, older people, and individuals with weak immune systems, according to webmd.com.
If you or a loved one has been sickened by E. coli and/or salmonella and you believe it’s related to cookie dough or peanut butter, you need to seek legal advice.

Rick Shapiro has practiced personal injury law for over 30 years in Virginia, North Carolina, and throughout the Southeastern United States. He is a Board-Certified Civil Trial Advocate by the National Board of Trial Advocacy (ABA Accredited) and has litigated injury cases throughout the eastern United States, including wrongful death, trucking, faulty products, railroad, and medical negligence claims. During his three-decade career, Shapiro has won client appeals before the VA Supreme Court, VA Court of Appeals, NC Supreme Court, SC Supreme Court, WV Supreme Court, TN Supreme Court, and three times before the United States Court of Appeals for the Fourth Circuit, underscoring Shapiro’s trial achievements. In addition, he and his law firm have won settlements/verdicts in excess of $100 million. His success in and out of the courtroom is a big reason why he was named 2019 “Lawyer of the Year” in railroad law in U.S. News & World Report's Best Lawyers publication (Norfolk, VA area), and he has been named a “Best Lawyer” and “Super Lawyer” by those peer-reviewed organizations for multiple years. Rick was also named a “Leader in the Law, Class of 2022” by Virginia Lawyers Weekly (total of 33 statewide honorees consisting of lawyers and judges across Virginia). And in September 2023, Rick was selected as a recipient of the National Board of Trial Advocacy (NBTA) 2023 President’s Award. Although many nominations were submitted from across the country, Rick was just one of eight attorneys chosen by the prestigious National Board which certifies civil trial attorneys across the U.S. Rick was also recently named to Virginia Lawyers Weekly 2024 Virginia’s Go To Lawyers Medical Malpractice. The attorneys awarded this honor are nominated by their colleagues and chosen by a panel from the publication.

Like I've said before, are there too many lawsuits or too many injuries?
