West Virginia State Police stated April 24 that a man has been arrested and charged for the drunk driving death of a woman in the southern part of the state.

Media reports stated that a 40 year old male from Panther, West Virginia has been charged with DUI resulting in death stemming from an accident last Friday that killed a 78 year old woman.

A state trooper reported that the allegedly drunk man’s SUV crossed the double yellow line on US Route 52 in West Virginia, then slammed head on into the woman’s car.

The man had two children in the car, and other charges are pending against the driver.

Our View

From 2003 to 2012, 1092 people died in drunk driving wrecks in West Virginia, according to the CDC. This is a rate of 5.6 per 100,000 people, which is far above the national average. There is no question that far too many drunk driving deaths are occurring in West Virginia, and our personal injury attorneys in Virginia hope that drunk drivers are prosecuted as aggressively as possible.

Many people are arrested for drunk driving in West Virginia as well that do not hurt anyone, but they easily could. In 2007, for example, 6327 drunk drivers were arrested in the state.

Our personal injury attorneys make it a policy to sue drunk drivers for personal injuries and wrongful death when their foolish actions have led to disaster for our clients.

Our goal in each drunk driving case is to find all possible sources of money in insurance policies. This way, clients can receive as much compensation as possible for all of the many expenses that inevitably result from these accidents.

For example, injured drivers and passengers of drunk drivers often have very expensive medical bills, lost job wages, long term, devastating injuries, and also pain and suffering.

In cases where the drunk driver engaged in truly outrageous behavior, we also try to bring punitive damage claims, too. We are skilled in showing in court if the drunk driver was extremely negligent, depending upon the details of the DUI case.

We handled a DUI case in Virginia a few years ago where a drunk driver slammed into the rear of our clients’ car. This led to some serious injuries that we were able to get compensation for in the amount of $112,000.

We hope that our aggressive efforts to sue drunk drivers will cause them to think twice before they get behind the wheel. Drunk driving just leads to death and destruction, not to mention financial and criminal penalties.
