A man from Martinsburg WV that was chased by police last week that ended in a multi vehicle crash on WV 9 has been accused of driving under the influence and injuring another driver.

The West Virginia State Police stated that the suspected drunk driver was charged with single counts of fleeing in a vehicle from a law-enforcement officer causing bodily injury and driving under the influence with serious bodily injury, according to Berkeley County Magistrate Court records.

The BAC of the suspected DUI driver was 0.181, which is more than double the legal limit.

The DUI suspect was driving at high speed on WV 9 in a Ford Explorer while being pursued by police, and slammed into the rear of a BMW. Police said that he was driving at over 100 MPH before the wreck.

The woman driver of the BMW was transported to a local Virginia hospital for serious injuries.

Our View

Our Virginia and West Virginia personal injury attorneys who specialize in drunk driving personal injury cases hope that the injured woman in this case recovers as soon as possible. It is unfortunate that so many drivers choose to drink and drive, and worse, run from the police and hurt an innocent person.

The innocent driver who was injured should consider her legal options and file a personal injury lawsuit against the other driver and his insurance company. His insurance policy should be able to provide funds to help her recover and to pay for her lost wages. We have had success with drunk driving cases and winning settlements of $500,000 and more for our clients.
