Police in Loudoun County, Virginia have arrested a 26 year old man in an alleged drunk driving crash that killed a women and injured one other on Feb. 21.

The Virginia State Police reported that the drunk driver crashed his Jeep into a traffic divider on Route 28 near Frying Pan Road in Loudoun County. The Jeep then flipped and two female passengers were thrown from the vehicle.

One of the women was 22 years old from Leesburg and she died at the scene of the drunk driving accident. The other woman had non-life-threatening injuries and was taken to a local hospital.

Our View

Drunk driving continues to be the scourge of the roads in America and in Virginia. At least 9900 people died in drunk driving crashes in 2014.  MADD reports that the highest rate of drunk driving is for men from 26 to 29 years old; the driver in the above drunk driving case is 26 years old.

Our Virginia and North Carolina personal injury attorneys regularly see drunk driving cases that lead to serious injury and death. We wish that these tragic accidents would not happen. But as long as they do, our drunk driving personal injury attorneys will continue to hold drunk drivers accountable in civil court.

Many people do not realize that a drunk driver who kills someone can not only be convicted in a criminal court and sent to prison. He or she also can be found liable in a wrongful death lawsuit and be compelled to pay a large judgement. This amount can vary, but wrongful death verdicts and settlements often are in the millions of dollars.

Our Virginia wrongful death attorneys once settled a tractor trailer accident case for $3.5 million when the trucker rear ended our client in I-64 in Virginia, killing him instantly.

Our attorneys proved that the truck driver did not see our client’s car until the last second before the wreck.

The defense argued that our client caused the crash because he was going 25 MPH at night after a tire problem. But we showed that the truck driver was not following Virginia CDL rules and he also had an untreated medical condition that contributed to the accident.

Wrongful death lawsuits are highly complex, and it takes a skilled and experienced personal injury attorney to obtain maximum compensation for the grieving family.

We were glad that we were able to obtain such a large settlement in that truck crash case; the funds were needed to care for the deceased man’s young child. At the very least, we were able to ensure she would get the care she needed until she reached adulthood.
