A fatal drunk driving crash happened on the evening of April 8 in Greenville, South Carolina. The South Carolina Highway Patrol stated the deadly accident happened at South Pleasantburg Drive at Augusta Road.

Troopers stated a 1999 Toyota was going north on South Pleasantburg and made a U-turn. As the vehicle was turning, troopers said it was struck on the right front side by another vehicle.

The passenger was seriously injured in the Toyota and he passed away at the hospital. The driver of the Toyota has been charged with felony DUI with death, driving under suspension, liquor law violation and habitual offender law. The driver in the other car was not hurt.

Our View

Our North Carolina and Virginia personal injury attorneys send our condolences to the family of the deceased. Drunk driving continues to be a menace on our roads, with thousands killed each year from drinking and driving. The CDC reports 10,265 people died in drunk driving crashes in 2015, and drunk driving accounts for 1/3 of traffic deaths each year.

If you are in an auto accident where the other driver was under the influence of drugs or alcohol, there is a good chance that you can get compensation from any injuries from the crash. You also can receive compensation if your loved one is killed by a drunk driver by filing a wrongful death lawsuit.

In many drunk driving crashes, it is often best to talk to the insurance company for the other driver before filing suit. But if the insured is convicted of DUI in connection with the accident, especially if death was involved, many insurance companies will pay top dollar in a settlement to avoid a lawsuit. Juries typically have very little sympathy for drunk drivers who injure or kill innocent people, and the verdict could end up costing the insurer much more than settling.

Our drunk driving attorneys handled a DUI case in Norfolk where our client was walking out of the gym. A drunk driver drove onto the sidewalk and hit his lower leg. He had to have four different surgeries on his lower leg and he had to have months of rehabilitation. The drunk driver only had $100,000 of coverage, so that was the maximum amount that could be obtained in this case.
